For many landowners, the opportunity to lease some land to a wind turbine developer comes with many financial benefits.

Agreements can be entered into whereby windfarm companies rent land that houses the turbines.

This can generate a good annual income for landowners. Some wind farm companies also give the landowner access to the clean energy it produces.

Unfortunately, leasing land to windfarm companies can come with issues and complications.

Unless agreements have been drafted carefully, landowners can be tied into contractual arrangements for long periods of time without receiving the income that they envisaged.

Delays in the installation of turbines, long waiting times for production or limited production can stop the land from generating income.

This can cause concern to landowners if the contractual arrangements leave them with little ability to move the project forward.

Some landowners who have not been properly advised, have found that they have lost the immediate benefit of the land and yet are deriving no rental income. Occasionally the wind turbine isn’t even fit for purpose.

If you have experienced any of the above issues, contact one of our specialist professional negligence solicitors who may be able to assist you.

We can consider your personal situation and advise whether there are any legal remedies available to you.
